Bristol County DA appeals judges ruling to vacate Aaron Hernandez murder conviction

Bristol County District Attorney Thomas M. Quinn III’s office has​ filed its appeal of a Fall River Superior Court judge’s May 9th ruling to apply Abatement Ab Initio to vacate the 2015 murder conviction of Aaron Hernandez.

On April 15, 2015, Mr. Hernandez was convicted after trial of the June 17, 2013 murder of Odin Lloyd in North Attleboro.

The appeal was filed with the Single Justice of the Massachusetts Supreme Judicial Court. A copy of the appeal is attached to this email.

“This is an archaic rule not based on the Constitution, and it should be changed. A defendant who commits suicide should not be able to manipulate the outcome of his post-conviction proceedings to achieve in death what he would not be able to achieve in life,” District Attorney Quinn said. “We are asking the Supreme Judicial Court to address this antiquated rule, which does not serve the public interest.”
